Manitoba Landlord Resources

Manitoba Landlord Resources is a regional overview of organizations that support landlord knowledge and education in Manitoba. This listicle continues the provincial resources, with direct quotes from the individual websites,  for landlords.  I  started this project three weeks with Alberta Landlord Resources. Winnipeg  Landlord Resources is the fourth in the series. I’ll keep adding provincial and some municipal resources until I’ve covered all 10 provinces.

Manitoba Residential Tenancies Act, November 1, 2021

This is the landlord-tenant legislation in Manitoba that applies to tenancy agreements, rental units, and other residential property.

Manitoba Residential Tenancies Branch

The Residential Tenancies Branch provides information on rent, repairs, and deposits, and mediates disputes between tenants and landlords. They provide information on rights and responsibilities during a tenancy, investigate problems, and hold hearings to make decisions and issue orders on certain issues.

The Life Leases Act – Manitoba

The Residential Tenancies Branch administers The Life Leases Act. A life lease can be for the tenant’s life or for a specific term (e.g., 50 years). Under a life lease, a tenant pays an entrance fee for a rental unit. The tenant also pays rent each month to cover maintenance and other expenses.

Manitoba Human Rights Act

The Human Rights Act protects rights to equality without discrimination based on the protected grounds of disability, age (18 or more), religion or religious creed, family status, marital status, sex, sexual orientation, race or perceived race, nationality, place of origin, ancestry, colour, receipt of public assistance, and gender identity. Discrimination based on any of these protected areas is against the law when a person is applying for rental accommodation or housing. For example, it is illegal to have a rental lease or agreement term that requires tenants of a particular ancestry to pay a higher damage deposit.

In every province in Canada, organizations have been set up to provide essential legal information to members of the public. These organizations do not provide legal advice or assistance. Their goal is only to inform and educate Canadians about the law and the legal system.

211 Manitoba

211 Manitoba  provides information to landlords and tenants on their rights and responsibilities under The Residential Tenancies Act and The Life Leases Act;

  • provides information by phone, through walk-in interview, or by letter
  • investigates complaints alleging contravention of the Residential Tenancies Act or the Life Leases Act
  • regulates residential rent increases throughout the province by annually establishing a percentage amount above which rents can NOT be increased without approval of the Branch
  • mediates disputes between landlords and tenants including, deposit claims, claims for compensation, notices of termination
  • adjudicates disputes between landlords and tenants, either at a hearing or from written information received from a landlord and a tenant during investigation (these decisions may be appealed to the Residential Tenancies Commission)

FIPPA

The Freedom of Information and Protection of Privacy Act (FIPPA) is an information rights law that gives an individual a legal right of access to records held by Manitoba public bodies, subject to specific and limited exceptions.  The Act also requires that public bodies protect the privacy of an individual’s personal information existing in records held by public bodies. FIPPA came into force on May 4, 1998,

and replaced the Freedom of Information Act.

The Manitoba Landlords Association and Canada Landlords Association Website

This website is provided by the Manitoba Landlord Association and the Canada Landlords Association. It is an online community, a portal for landlords involved in renting property – novice and experienced alike. They provide free access to information, resources, and suppliers of value to residential and commercial landlords, tenants, real estate agents, property managers, and other property professionals.

The Manitoba Securities Commission

The Manitoba Securities Commission administers The Real Estate Brokers Act. This Act seeks to protect home buyers and sellers by regulating brokers and salespersons as defined by the Act.

The Safer Communities and Neighbourhoods Act – Manitoba

The Safer Communities and Neighbourhoods Act holds property owners accountable for threatening or disturbing activities that regularly take place on their property related to:

  • Unlawful drug use or dealing, production, or cultivation
  • Prostitution and related activities  
  • Unlawful sale of liquor
  • Unlawful use or sale of intoxicating substances – non-potable and solvent-based product  
  • Sexual abuse or exploitation of a child or related activities
  • Possession or storage of an unlawful firearm, weapon, or explosive
  • Participation in a Criminal Organization offence

 The act refers to ongoing activities, not those happening occasionally.

Manitoba Non-Profit Housing Association (MNPHA)

The Manitoba Non-Profit Housing Association is a paid membership that represents over 100 non-profit housing providers who collectively own and manage more than 24,000 affordable homes across 23 communities in Manitoba.  They offer professional development opportunities, including networking and knowledge exchange.

Manitoba Housing

Manitoba Housing provides opportunities for subsidized rental housing in both properties that Manitoba Housing owns and operates and in properties owned and operated by private and non-profit housing partners.
